1. General Terms
1.1. The online store Tixruli Minaqari sells products available in Tixruli Minanqari stores, owned by the company Tihruli Minanqari OÜ (hereinafter referred to as "Products").
1.2. These terms apply to the legal relationships between the customer (hereinafter referred to as "Customer") and Tihruli Minanqari OÜ (hereinafter referred to as "Seller"), the owner of the shopping environment located at www.TixruliMinanqari.ee (hereinafter referred to as "online store"), regarding the purchase of Products from the online store. In addition to these terms, the legal relationships arising from the purchase of Products in the online store are governed by the laws applicable in the Republic of Estonia.

2. Prices
2.1.All prices indicated in the online store are presented in euros and are final.
3. Products
3.1. Products displayed in the online store are generally available in stock. The availability of the listed Products is not guaranteed, as this information may be incorrect due to potential technical issues in the online store systems.
3.2. If a Customer places an order but it turns out that the desired Product is out of stock, the online store will not be able to fulfill the order. In such a case, a representative of the online store will contact the customer to offer a replacement product, provide information on the possible delivery time, or refund the Customer’s payment within 10 days.
3.3. Photos displayed in the online store are for illustrative purposes and may slightly differ from the actual appearance of the Product.
4. Purchase Procedure
4.1. The Customer selects the desired Product in the online store and adds it to the shopping cart by clicking the "Add to Cart" button.
4.2. To complete the order, the Customer should click the "Proceed to Payment" button in the cart, after which they will be redirected to the order completion page. After entering the required information, the Customer pays for the Product using a bank link in the online bank and confirms the order by clicking the "Return to Seller" button.
4.3. Fill in all of the required fields and choose the most suitable shipping method to complete the order. The total cost is then displayed on the screen. This can be paid securely via the following payment methods provided by Maksekeskus AS:
- Estonian bank payments: Swedbank, SEB, Luminor, LHV, Coop Pank, Pocopay, Citadele
- Latvian bank payments: Swedbank, SEB, Citadele and Luminor
- Lithuanian bank payments: Swedbank, SEB and Luminor, Šiaulių Bankas
- Card payments: Visa / MasterCard
- Gift card: Kniks gift card
NB! When using a bank link payment confirm the order and then click on the ‘Return to merchant’ button.
The personal data necessary for the execution of payments is transferred to authorized processor Maksekeskus AS. The contract enters into force when the amount payable is transferred to the bank account of the online store.
4.4. After payment is completed, the online store will send the Customer an order confirmation via email.
4.5. The Customer is required to provide accurate information necessary for the completion of the order.
4.6. The Seller is not liable for the inability to fulfill the order due to incorrect information provided by the Customer when placing the order, or for any resulting consequences.
5. Shipment
5.1. At Tixruli Minanqari online store, you can order delivery of parcels to addresses in Estonia, Latvia, and Lithuania.
5.2. These options are available for receiving the order: omniva, dpd
5.3.The purchaser bears the shipping cost and the respective price information is displayed next to the shipping method.
5.4. For parcel delivery to a parcel locker, deliveries in Estonia take 1-2 business days, in Latvia 2-5 business days, and in Lithuania 4-10 business days. Larger orders may take longer due to the need for assembling the products. Additionally, during pre-holiday periods and promotional events, delivery times may be extended by 1-2 days.
5.5. Conditions for Delivery of Custom Orders and Out-of-Stock Items
Order fulfillment and delivery times range from 15 to 30 business days.
During vacation periods and times of high demand, delivery times may be subject to change.
6. Right of Withdrawal
6.1. You have the right to exchange or return the ordered product within 14 days. The 14-day period begins from the day the product is received.
6.2. To withdraw from the contract, the Customer must send a withdrawal notice to the email address tmwearpersonal@gmail.com.
6.3. The product should be returned using the same method by which it was delivered.
6.4. If using the above-mentioned return methods, the return will be free of charge for the Customer. For other return methods, the Seller is not obliged to reimburse the Customer for transportation costs related to the return of the product.
6.5. The Seller will refund the price of the returned Product(s), including any delivery costs incurred by the Customer, to the Customer’s bank account within 14 days from the receipt of the withdrawal notice. The Customer must return the product to the Seller within 14 days from the date of sending the withdrawal notice. The online store may refuse to refund until the returned product(s) is/are received by the Seller or until the Customer provides proof of returning the product, whichever occurs first. The returned Product must be unused, undamaged, and clean, and must not show signs of use. The Product must be complete (including packaging and all items contained in the packaging – instructions, certificate, etc.).
6.6. If the product has been used for purposes other than those necessary for familiarization with and determining the characteristics and functionality of the product or shows signs of use or wear, the online store has the right to reduce the refund amount according to the reduction in the product's value.
7. Complaints Procedure
7.1. A 2-year term for filing complaints applies to products sold in the online store, according to Section 218(2) of the Law of Obligations Act (LOA). Disputes between the Customer and Seller are resolved through negotiations.
7.2. If a defect is found, the Customer has the right to contact the online store within two months by sending an email to tmwearpersonal@gmail.com.
7.3. If the products purchased from the online store have defects for which the Seller is responsible, the Seller will repair or replace the defective product. If the product cannot be repaired or replaced, the Seller will refund all payments associated with the sales contract.
7.4. The Seller will respond to complaints made by the consumer as soon as possible, but no later than 15 days from the receipt of the complaint.
7.5. According to Section 222(1) of the LOA, if the product does not meet the contractual terms, the Customer has the right to request repair or replacement of the product. In case of non-compliance with the contractual terms, the Seller will bear the costs associated with repairing or replacing the product (mainly transportation and postal costs, travel expenses, and materials).
7.6. The Seller is not responsible for damages arising from the use of ordered products for purposes other than intended or for delivery delays caused by circumstances beyond the Seller’s control and/or due to force majeure.
8. Liability
8.1. The Seller and Customer are liable to each other for damages caused by a breach of these Terms of Use in the cases and to the extent provided by the laws applicable in the Republic of Estonia.
8.2. The Seller’s liability is limited to the sale price of the Product.
8.3. The Customer agrees to use the online store services only for lawful and generally accepted purposes.
9. Terms of Use and Amendments
9.1. By registering in the online store or making a purchase, the Customer agrees to the Terms of Use of the online store and undertakes to comply with them.
9.2. The sales contract between the Seller and Customer comes into effect upon receipt of the payment due on the Seller’s bank account.
9.3. The Seller may change the Terms of Use of the online store and product prices without prior notice. Notification of such changes will be published in the online store's electronic environment. The prices and other terms visible to the customer at the time of the transaction will apply to the sales transaction.
9.4. The Seller reserves the right to cancel the order if, due to a technical error, the price of the Product displayed in the online store was incorrect.
10. Gift card Terms and Conditions
10.1. The gift card is valid for 1 year from the date of purchase.
10.2. The card can be used for a single payment up to the amount specified on the card.
10.3. Gift cards cannot be exchanged for cash.
10.4. Gift cards purchased from the online store are non-returnable.
10.5. Gift cards are not eligible for discounts, promotions, or other special offers.
11. Other Terms
11.1. Disputes between the Customer and Seller are resolved through negotiations. If an agreement cannot be reached, the Customer may contact the Consumer Disputes Committee. More information on the complaint process and how to file a complaint can be found here. The Consumer Disputes Committee handles disputes arising from contracts between the Customer and Seller free of charge.
The Customer may also use the European Union Online Dispute Resolution platform.
